Nigerian constitution unfair to Moslems — retired Supreme Court judge

From SHEHU EL-HAFIZ, Dutse

A RETIRED Supreme Court Judge, Justice Abubakar Bashir Wali, has faulted the Nigerian Constitution as it relates to the Moslems.

Speaking in Dutse, Jigawa State, Wali suggested that anything that affected the Moslems should be referred to a Shari'a court and not a conventional court, because’', it is the right of every Moslem.'’

He was addressing the opening session of a three-day stakeholders' workshop on the
review of the Laws of Jigawa State.

He said states interested in the implementation of Shari'a should do so in the interest of the people.
He was of the view that ''Shari'a is the right of every Muslim in the country; limiting sharia to a customary court is unfair'.

In his opening remark, the Attorney-General and state Commissioner of Justice, Justice Tijjani Inuwa noted that the laws of Jigawa were last reviewed in 1998.

He explained that laws, whether federal or state, were required to be subjected to a comprehensive review excercise in every 10years of its existence due to the dynamism of human society.

''A law enacted in the last 10 years may not possibly work properly in our present situation; therefore the purpose for which the law was enacted has been defeated. To make the law work properly it most be reviewed to reflect present realities,'' he said.

He then urged all the participating stakeholders at the workshop to make positive inputs during the interactive session in order to achieve the purpose of the exercise.

Also speaking at the occasion, the chairman ofthe occasion, who is the Jigawa state Chief Judge, Justice Tijjani Wali described the exercise as'' timely and essential for the progress of the state.''
